DEFINITIONS.

Unless otherwise stated the the following definitions will apply:

a) The Company means Tweedlecoate.

b) The Author or The Client means the individual or organisation entering into a contract with Tweedlecoate.

  1. PRICES
    Any prices shown on the website may change at any time. Any quotes given will be valid for the duration stated on the quote or for 30 calendar days from the creation of the quote if not specifically stated. Prices and fees quoted based on the services and goods provided by subcontractors and third party suppliers are subject to change with no notice.
  2. TAX
    Prices stated on the website or in any quote will not include any applicable VAT unless otherwise stated.
  3. PAYMENTS
    The quoted fees for fixed price packages are due to be paid to The Company in advance of any work commencing unless otherwise stated in writing. Larger scale projects including (but not limited to) ghostwriting and graphic design projects may be funded through staged payments. Staged payment options will be based upon agreed milestones and will be determined on a per project basis. The first payment stage will always be the commencement of the project.
  4. DELIVERY
    The Company will deliver content as agreed in writing with The Author. Delivery will include only the items stated in writing to The Author except where those items are an extra provided without warranty and free of charge.
    Any physical goods delivered will be sent via contracted couriers and postal services. Any damages or losses will be claimed by The Customer from the respective service. The Company are not liable for issues arising from transport and delivery.
  5. REFUNDS AND TERMINATION
    Once a contract is entered into by The Company and The Author, refunds will only be payable on termination of the contract in writing for reasons given in these Terms & Conditions. The Author has the right to cancel within 14 days of agreement subject to the following limitations: where work has already taken place on behalf of The Author, The Company will retain a fair proportion of the paid fees to cover that work, this will be calculated based on the estimated average time investment for that work; a handling fee will be retained by The Company to cover any expenses in time, materials and services in respect of the termination of the contract. In the case of termination by The Author after titles have been published no refunds will be applicable. In the case of termination of the contract by The Company, these retentions will remain in place.
  6. LIABILITY
    The Company shall not be liable for any loss to The Author arising from delay in transit not caused by The Company. The Company accepts no liability for consequential loss. No claim will be considered which exceeds the sales invoice value by The Company for any faulty goods or service.
  7. PHYSICAL AND ELECTRONIC MATERIAL
    Physical and electronic property provided by The Company in addition to the core service provided will remain the property of The Company.
    Physical and electronic property provided by The Author will remain the property of The Author.
  8. COPYRIGHT
    The copyright of all manuscript content created by The Author remain with The Author. The Company make no claim regarding copyright on the creative output of The Author. Copyright of all materials created by The Company remains with The Company (including, but not limited to: graphics, cover art, design materials, marketing materials, social media posts). The right to use materials created by The Company is freely given to The Author to use in any manner The Author wishes (including, but not limited to: marketing materials, social media posts, catalogue submissions) with the limitation that The Author does not use these materials in a way that could cause negative impact to The Company including the sale of these materials other than their inclusion in their published books. The right to use materials created by The Author is freely given to The Company to use in any manner The Company wishes (including, but not limited to: marketing materials, social media posts, catalogue submissions).
  9. MANUSCRIPT SUBMISSION
    Manuscripts and other materials submitted to The Company will be submitted using the guidelines provided by The Company on this website. The Company reserves the right to reject any manuscripts and materials submitted which do not follow these published guidelines.
  10. ILLEGAL OR INAPPROPRIATE CONTENT
    The Company reserves the right to reject or to remove any content it deems to be illegal or inappropriate. Where there is any uncertainty The Author is able to discuss the matter with The Company. In all cases, the decision of The Company will be final. The Company reserves the right to decline any content without reason.
  11. ARTIFICIAL INTELLIGENCE
    The Author must agree that no part of their work is generated using generative AI tools. This restriction includes both written and image content. The Company may choose to remove works which are found to have been created using generative AI tools. Exceptions to this restriction include the use of AI tools as part of the creative process (such as image manipulation where the original image is being edited using AI features of software or AI is used to assist with research).
  12. FORCE MAJEURE
    The Company shall be under no liability for inability to carry out any contracted work for any reason beyond its control including (but not limited to); Act of God; legislation; war; political change; injury or illness; flood; drought; failure of power supply; failure of external service; lock-out, strike or other action taken by its employees or employees of its subcontractors; inability to procure materials required for the performance of the contract. During the continuance of such a contingency The Author may by written notice to The Company elect to terminate the contract and pay for work done and materials used, but subject thereto shall otherwise accept delivery when available.
  13. VARIATION OF TERMS
    No variation of these terms will be accepted unless agreed in writing by a director of The Company.
  14. PROJECT COMPLETION AND CHANGES
    A book project, whether a standard package or a bespoke project, at the time it is sent to the printers. At this time the content will be regarded as accepted by The Client. Any changes made to the contents after this time will be regarded as a requested change and will be subject to an additional charge. For minor changes such as corrections this will be at the rate charged to Tweedlecoate by the printers. For more significant changes, a fresh quote and subsequent invoice will be raised.
  15. COMPETITIONS
    Competition rules and terms will be stated on the relevant competition page and will be regarded as being in addition to these Terms and Conditions.
  16. LAW
    These conditions and all other express terms of the contract shall be governed and construed in accordance with the laws of England.
